1997 Plannning, Zoning, and Development Laws

INTRODUCTION

The Governor's Office of Planning and Research (OPR) has compiled the 1997 Planning, Zoning, and Development Laws. This publication is prepared annually as a convenient resource to local governments and the public. This 1997 edition includes planning laws enacted through 1996. The statutory changes which were enacted in 1996 are highlighted throughout the publication to alert readers to recent changes.

OPR staff receives hundreds of requests for technical assistance each year from local public planning agencies. In an effort to address some of these technical assistance requests, the 1997 Planning, Zoning, and Development Laws is comprised not only of planning and zoning laws, but also excerpts from related statutes. These excerpts are located in the "Miscellaneous Planning-Related Laws" section, and include such subjects a common interest subdivisions, school and community college sites, airport land use planning, fees, and Outdoor Advertising Act, integrated solid waste management plans, zoning of health facilities and other types of care facilities, and local regulation of alcoholism recovery facilities. The publication also contains an appendix of other planning-related statutes that are not set forth in the main text.

Legislative Summary

The following summarizes the major planning and land use legislation enacted in 1996. This is provided to familiarize the reader with the most recent changes in planning and zoning laws. These bills are incorporated into this edition of the Planning, Zoning and Development Laws. Unless otherwise noted, this legislation became effective on January 1, 1997.

AB 771 (Chapter 46) -- allows a parcel map to be extended for up to five additional years and provides an automatic, statutory exemption for all viable tentative maps (as of September 1, 1996) or two years from their date of expiration. Urgency.

AB 2419 (Chapter 293) -- deletes the requirement for a trip reduction element, and allows counties to opt out of the congestion management plan requirement by a vote of the county and cities.

AB 3125 (Chapter 347) -- allows a city or county to count toward its regional housing share permanent housing units on a military base undergoing closure which will be available for occupancy during the planning period.

AB 3452 (Chapter 1018) --authorizes the County of Napa, provided certain conditions are met, to meet up to 15% of its existing regional housing share by committing county funds to the construction of units in cities within the county.

AB 3472 (Chapter 872) -- clarifies the general plan extension authority of the OPR director.

SB 560 (Chapter 894) -- allows up to five years of extensions on an approved tentative map and expands the list of corrections which may be made to final maps.

SB 1073 (Chapter 39) -- extends the deadline for the next update of local housing elements by four years. Urgency.
