IMPORTANT DISTINCTIONS BETWEEN DUTIES OF
LEAD AND RESPONSIBLE AGENCIES
- State Lead
Agencies
- Must file with OPR.
- NOD
must contain a statement that EIR or negative declaration was prepared and
certified or adopted pursuant to CEQA
- Filing
and posting of NOD commences running of 30 day statute of limitations.
- Authorities:
- State
Responsible Agencies
- Encouraged but not required to file with OPR
- NOD should state that the EIR or negative declaration
was "considered" during project approval.
- Authorities:
- Local Lead
Agencies
- Must file with County Clerk (and with OPR if state discretionary
approval is required).
- NOD must contain a statement that EIR or negative declaration was
prepared and certified or adopted pursuant to CEQA
- Filing
and posting of NOD commences running of 30 day statute of limitations.
- Authorities:
- Local Responsible
Agencies
- Encouraged but not required to file with County Clerk
(and with OPR where state discretionary approval is suggested).
